Château Gâteaux Loyalty App – Terms and Conditions

1. Introduction

1.1 These Terms and Conditions (“Terms”) govern your use of the Château Gâteaux Loyalty App (“the App”), operated by Château Gâteaux (Pty) Ltd (Registration Number 1999/014744/07), with its registered address at 1 Imvubupark Close, Riverhorse Valley Business Estate, Effingham, Durban, KwaZulu-Natal, South Africa (“Château Gâteaux”, “we”, “us”, or “our”).

1.2 By downloading, accessing, or using the App, you agree to be bound by these Terms.

1.3 Château Gâteaux reserves the right to amend, suspend, or terminate the App, Loyalty Programme, or these Terms at any time, provided reasonable notice is given via the App or other appropriate communication channels.

1.4 Any amendments will not affect cashback or vouchers validly earned prior to the effective date of the change, unless required by law.

2. Eligibility and Use

2.1 You must be 18 years or older to use the App, or have the consent and supervision of a legal guardian.

2.2 You agree to use the App only for lawful purposes and in accordance with these Terms.

3. Registration and User Profile

3.1 You are required to create a personal profile to use the App.

3.2 You warrant that all information provided is true, accurate, and complete.

3.3 Creating multiple profiles or providing false information constitutes fraud and may result in:

• Immediate account suspension or termination
• Forfeiture of rewards and cashback

3.4 You are responsible for maintaining the confidentiality of your account and all activity under it.

3.5 Château Gâteaux reserves the right to suspend accounts where suspicious or abusive behaviour is detected.

4. Rewards and Benefits

4.1 Registration Reward

• One (1) complimentary regular hot beverage (coffee or tea)
• Redeemable at any Château Gâteaux store

4.2 Welcome Back Reward

• Available to users migrating from the previous loyalty app
• Valid until 31 December 2026
• Includes:
  • Purchase any hot beverage
  • Receive one (1) complimentary slice of cake

4.3 Birthday Voucher

• Must register at least 24 hours before birthday month
• Loaded on the 1st day of your birthday month
• Valid for that month only
• Benefit:
  • R100 off any large cake
• Eligible users are automatically entered into the Château Gâteaux 365 Birthday Campaign:
  • Daily random prize: one (1) complimentary large cake

5. Loyalty Cashback

5.1 Users earn 3% cashback on qualifying purchases.

5.2 Cashback:

• Reflects after transaction completion
• Expires after 12 months
• Can be used as partial or full payment

5.3 Cashback:

• Is not legal tender
• Cannot be transferred, exchanged, or redeemed for cash

5.4 Cashback cannot be earned in conjunction with promotions or discounts unless stated otherwise.

5.5 Château Gâteaux reserves the right to:

• Correct errors in cashback allocation
• Withdraw or substitute rewards

6. Gift Vouchers

• Minimum value: R50
• Maximum value: R1000
• Valid for 3 years
• Non-refundable and not redeemable for cash

6.1 Cashback is earned when purchasing vouchers, but not when redeeming them.

7. Hot Beverage Stamp Card

7.1 Users will earn one (1) digital stamp for every qualifying hot beverage purchased at a participating Château Gâteaux Patisserie.

• To earn a stamp, the user must scan the App when completing the purchase of a hot beverage.
• Each qualifying hot beverage purchased earns one (1) stamp. Complimentary beverages, including redeemed rewards, do not earn stamps.
• Once a user has collected ten (10) stamps, they will automatically unlock a reward for one (1) complimentary regular hot beverage.
• The reward will be loaded onto the user’s App profile and must be redeemed within 3 months of receiving the reward in the App.
• The complimentary beverage is subject to product and ingredient availability. Extras, substitutions, size upgrades, alternative milk options, syrups, or other add-ons may incur an additional charge.
• The reward may not be exchanged for cash, transferred to another user, or used in conjunction with another promotion, discount, voucher, or offer unless otherwise stated.
• Once the reward has been redeemed, the completed stamp card will reset, and the user may begin collecting stamps towards their next complimentary beverage.
• Stamps have no monetary value and cannot be transferred, exchanged, or redeemed for cash.
• Château Gâteaux reserves the right to correct stamps allocated in error or remove stamps obtained through fraudulent, abusive, duplicated, reversed, cancelled, or refunded transactions.
• Château Gâteaux may amend, suspend, or discontinue the Hot Beverage Stamp Card, subject to reasonable notice and applicable law.

8. Promotional Offers and Third-Party Partner Promotions

8.1 Unless otherwise stated, promotional offers available through the App:

• Cannot be combined with other offers;
• Are subject to availability;
• May not be available at all Château Gâteaux Patisseries; and
• May be subject to additional terms and conditions communicated at the time of the promotion.

8.2 From time to time, Château Gâteaux may collaborate with third-party organisations, including, but not limited to, telecommunications providers, financial institutions, retailers, loyalty programme providers, payment service providers, and other commercial partners, to offer discounts, vouchers, cashback, rewards, competitions, giveaways, exclusive offers, or other promotional benefits through the App (collectively referred to as “Third-Party Promotions”).

8.3 Third-Party Promotions may be subject to additional or separate terms and conditions imposed by the relevant third-party partner. By participating in, accessing, claiming, or redeeming a Third-Party Promotion, you acknowledge and agree that you may also be bound by the applicable terms and conditions of the relevant third-party partner.

8.4 Where a Third-Party Promotion is subject to specific eligibility requirements, redemption criteria, qualifying purchases, validity periods, exclusions, limitations, or any other conditions, such requirements will be communicated as part of the applicable promotion and will apply in addition to these Terms.

8.5 Château Gâteaux does not control and is not responsible for the products, services, content, promotions, terms, conditions, eligibility requirements, or restrictions imposed by any third-party partner. Any questions, disputes, complaints, or claims relating specifically to a third-party partner’s products, services, or promotional offers may be subject to that third-party partner’s policies, procedures, and dispute-resolution processes.

8.6 Château Gâteaux does not guarantee the availability, continuity, duration, or continued offering of any Third-Party Promotion and reserves the right to amend, suspend, withdraw, substitute, or terminate any Third-Party Promotion at any time, subject to applicable law.

8.7 In the event of any inconsistency or conflict between these Terms and the terms and conditions applicable to a specific Third-Party Promotion, the terms and conditions of the specific promotion and/or the relevant third-party partner will prevail to the extent of the conflict, unless otherwise required by applicable South African law.

8.8 Nothing in this clause limits or excludes any rights afforded to consumers under the Consumer Protection Act, 2008, or any other applicable legislation in the Republic of South Africa.

9. Transition from Previous App

9.1 The App transitioned to a new platform effective 13 April 2026.

9.2 Cashback migration:

• Requires registration using the same mobile number
• Otherwise subject to manual approval

9.3 Old app vouchers:

• Valid until 31 March 2026
• Will not be reissued or extended

10. Intellectual Property

10.1 All App content (including trademarks, text, graphics, and designs) remains the property of Château Gâteaux or its licensors.

10.2 No content may be copied, reproduced, or used without prior written consent.

11. Privacy and Data Protection (POPIA Compliance)

11.1 We collect personal information including:

• Name and surname
• Date of birth
• Mobile number

11.2 Your information is used solely to:

• Operate the App
• Deliver rewards and services

11.3 By using the App, you consent to:

• Operational communications (e.g. OTPs)
• Marketing communications (only if opted-in)

11.4 You may opt out of marketing at any time.

11.5 Additional provisions:

• Data may be processed outside South Africa with safeguards
• Data retained for up to 3 years after inactivity
• Anonymous analytics may be used

12. Acceptable Use

You agree not to:

• Engage in illegal activity
• Submit false or misleading content
• Impersonate others
• Access other accounts
• Interfere with App functionality
• Use bots or automated systems

13. Liability and Disclaimers

13.1 The App may be unavailable due to maintenance or factors beyond our control.

13.2 To the maximum extent permitted by law:

• Château Gâteaux is not liable for indirect or consequential damages

13.3 Total liability is limited to:

• The value of cashback or vouchers in dispute

13.4 Nothing excludes liability for:

• Gross negligence
• Fraud
• Any rights under South African law

14. Indemnity

You indemnify and hold harmless Château Gâteaux, its employees, directors, and agents against any claims arising from:

• Misuse of the App
• Breach of these Terms

15. Suspension and Termination

Château Gâteaux may suspend or terminate accounts for:

• Fraud
• Abuse
• Breach of Terms

All associated rewards may be forfeited.

16. Governing Law

16.1 These Terms are governed by the laws of the Republic of South Africa.

16.2 Subject to:

• Consumer Protection Act, 2009 (CPA)
• Protection of Personal Information Act, 2013 (POPIA)

16.3 Disputes will be subject to South African courts.

17. General

17.1 If any provision is invalid, the remaining provisions remain enforceable.

17.2 Failure to enforce any right does not constitute waiver.

17.3 The App requires internet access; we are not responsible for connectivity issues.
