Terms & Conditions – Château Gâteaux Loyalty App

These Terms and Conditions govern your use of the Château Gâteaux Loyalty App (“the App”), operated by

Château Gâteaux (Pty) Ltd, Registration Number 1999/014744/07, with its registered address at 1 Imvubupark

Close, Riverhorse Valley Business Estate, Effingham, Durban, KwaZulu-Natal, South Africa (“Château Gâteaux”,

“we”, “us”, or “our”).

Château Gâteaux reserves the right, at its sole discretion, to amend, suspend, or terminate the Loyalty

Programme and/or these Terms at any time, provided reasonable notice is given via the App or through other

appropriate communication channels.

Any amendments will not affect cashback or vouchers that were validly earned prior to the effective date of the

change, unless otherwise required by law.

By using the App, you indemnify and hold harmless Château Gâteaux, its employees, directors, and agents against

any claims, damages, or losses arising from misuse of the App or breach of these Terms.1. Age Requirement

No person under the age of 18 may use the App without the consent and supervision of a legal guardian.

All content, trademarks, graphics, designs, text, icons, and data displayed on the App are the property of Château

Gâteaux or are licensed to us. These may not be copied, reproduced, downloaded, or used without our prior

written consent.

.1. Registration Reward

• The Registration Reward entitles the recipient to one (1) complimentary regular hot beverage, including

a coffee (espresso, americano, cappuccino) or tea.

• The reward is redeemable at any Château Gâteaux store nationwide.

2. Welcome Back Reward

• The “Welcome Back” migration voucher is available for customers who had the previous Château

Gâteaux loyalty app and who re-download and register on the new Château Gâteaux loyalty app; valid

until 31 December 2026.

• Each qualifying customer will receive one (1) voucher, valid for the remaining months of the calendar

year from the date of re-download.

• The voucher entitles the recipient to purchase any hot beverage and receive one (1) complimentary

slice of cake.

• The reward is redeemable at any Château Gâteaux store nationwide.

2.3. Birthday Voucher

• The Birthday Voucher is available to customers who download and register on the Château Gâteaux

loyalty app at least 24 hours prior to the start of their birthday month.

• Customers who do not complete the registration process or skip registration will not qualify to receive

their birthday reward.

• The Birthday Voucher will be loaded onto the customer’s loyalty app on the first (1st) day of their

birthday month and will remain valid until the end of the birthday month.

• The voucher entitles the recipient to R100 off any large cake, redeemable at any Château Gâteaux store

nationwide.• Customers who qualify for the Birthday Voucher will also be automatically entered into the Château

Gâteaux 365 Birthday Campaign for a chance to win one (1) complimentary large cake. Winners are

selected randomly each day throughout the year.

3. Your Profile

You are required to register a personal profile before using the App.

You warrant that all information provided during registration is true, accurate, and complete.

Providing false information and/or creating multiple profiles constitutes fraud and may result in immediate

termination of your profile. In such cases, all accumulated rewards and loyalty cashback will be forfeited. Château

Gâteaux reserves the right to suspend accounts where excessive, suspicious, or abusive usage patterns are

identified.

You are responsible for maintaining the confidentiality of your account and for all activities conducted under your

profile.

4. Transition from the Old Loyalty App to the New Loyalty App

4.1 Château Gâteaux has transitioned from its previous loyalty app provider to a new loyalty app provider to

enhance your user experience and provide improved access to rewards and discounts.

4.2 The transition period will commence on 13th April 2026.

4.3 As part of this transition, all available cashback balances reflected on the old loyalty app will be migrated to

the new loyalty app, provided that the customer registers on the new app using the same mobile number that

was used to register on the old app.

4.4 Where a customer registers on the new loyalty app using a different mobile number, the cashback balance will

not automatically migrate. In such instances, cashback may be manually loaded onto the new loyalty app profile,

subject to verification and at the sole discretion of Château Gâteaux.

4.5 All earned and issued vouchers on the old loyalty app will remain valid until 31 March 2026. No vouchers will be

re-issued, reloaded, or extended beyond this date.

5. Loyalty Rewards

With every qualifying purchase made using the App, you will earn loyalty cashback equal to 3% of your total

spend.

• Loyalty cashback reflects once the transaction is complete.

• It is your responsibility to ensure that cashback has been allocated correctly. While we take reasonable

steps to maintain accuracy, errors in pricing, reward allocation, or voucher displays may occur. Château

Gâteaux reserves the right to correct any such errors.

• If cashback does not reflect, please notify us via the “Talk to Us” section in the App.

• Loyalty cashback expires after 1 (One) year. years.

• Loyalty cashback may be used as partial or full payment in-store or via the App.

• Loyalty cashback is a promotional benefit and does not constitute legal tender, property, or a stored

monetary value. It may not be transferred, sold, or exchanged for cash under any circumstances.• Loyalty cashback cannot be earned in conjunction with any promotion / discount allocated to the sale.

All rewards and vouchers are subject to availability and may be withdrawn or substituted at the

Promoter’s discretion.

Château Gâteaux may, at its sole discretion, offer personalised rewards from time to time. Such rewards are not

guaranteed. To the fullest extent permitted by law, Château Gâteaux shall not be liable for any indirect, incidental,

or consequential damages.

6. Gift Vouchers

• Minimum gift voucher value: R50.00

• Maximum gift voucher value: R1000.00

• Gift vouchers are valid for 3 (three) years from date of purchase.

• Loyalty cashback is earned when purchasing gift vouchers, but not when redeeming them.

• Gift vouchers are non-refundable and cannot be exchanged for cash.

7. Promotional Offers

Unless otherwise stated, promotional offers:

• Cannot be used in conjunction with any other offer.

• Are subject to availability.

• May not be available at all Château Gâteaux stores nationwide.

8. Your Information & Privacy

When registering on the App, we collect certain personal information, including:

• Name and surname.

• Date of birth

• Mobile number

We collect only the information necessary to provide App services. We will not process or share your information

for any other purpose without your consent.

By accepting these Terms, you consent to receiving communications necessary for the operation of the App,

including OTP verification and service-related messages.

Marketing communications will only be sent where you have explicitly opted in. You may opt out at any time.

If location services are enabled, the App may use GPS technology to enable the “Find a Store” feature. Location

data is not stored or shared.

We may use analytics trackers for anonymous usage data to improve the App. This data is not used for direct

marketing.

We reserve the right to monitor App usage for operational purposes, including fraud prevention, risk assessment,

investigations, customer support, and compliance with these Terms and applicable laws.

Personal information may be shared with authorised third-party service providers (including app developers,

analytics providers, and communication platforms) solely for the purposes of operating the App and Loyalty

Programme.Personal information may be processed and stored outside of South Africa. Where this occurs, appropriate

safeguards will be in place in accordance with applicable data protection laws.

Personal information will be retained for no longer than 3 years after account inactivity, unless required by law.

9. Acceptable Use

When using the App, you agree not to:

• Submit false, misleading, or inauthentic reviews.

• Engage in illegal activity or violate any applicable laws.

• Impersonate any person or entity.

• Access another user’s profile without permission.

• Interfere with or disrupt App functionality, servers, or networks.

• Attempt to hack or access proprietary or confidential records.

• Collect or store personal information about other users.

• Use bots or automated systems to interact with the App.

10. General

The App may be temporarily unavailable due to maintenance, upgrades, emergency repairs, or circumstances

beyond our reasonable control. Château Gâteaux shall not be liable for any loss or inconvenience arising from

such interruptions. To the maximum extent permitted by law, Château Gâteaux shall not be liable for any indirect,

incidental, consequential, or special damages arising from the use of the App or participation in the Loyalty

Programme.

Our total liability for any claim arising from the use of the App shall not exceed the value of the loyalty cashback

or voucher in dispute. Any disputes will first be resolved through internal review before escalation.

Nothing in these Terms excludes liability for gross negligence, fraud, or any liability that cannot be excluded under

applicable law.

The App requires internet access, and we are not responsible for disruptions caused by connectivity issues.

Château Gâteaux shall not be liable for any failure to perform its obligations due to events beyond its reasonable

control, including but not limited to natural disasters, power failures, civil unrest, system failures, or interruptions

from third-party service providers.

Château Gâteaux reserves the right to suspend or terminate any profile where abuse, suspected fraud, misuse, or

a breach of these Terms is identified.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall

be subject to the jurisdiction of the courts of the Republic of South Africa.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain

valid and enforceable.Nothing in these Terms limits any rights afforded under the Consumer Protection Act, 2009, or the Protection of

Personal Information Act, 2013.
